STANDARD TERMS AND CONDITIONS OF SALE

By purchasing from Sunset Marine Tx, whether online or in person, Buyer agrees to the following Terms and Conditions.

AS-IS Sale – Boats, Motors & Trailers

All boats, motors, trailers, and other serialized major units are sold “AS IS, WHERE IS, WITH ALL FAULTS” and are FINAL SALE. No express or implied warranties are provided, including but not limited to warranties of merchantability or fitness for a particular purpose. Seller shall not be liable for prior or undisclosed damages, salvage history, insurance claims, mechanical defects, or related issues. Buyer acknowledges the opportunity to inspect and accepts the property in its present condition.

10-Day Return Policy (Select Eligible Items Only)

On select eligible merchandise only, Buyer is granted a ten (10) calendar day return period beginning on the date of delivery or pickup. All returns require prior Return Merchandise Authorization (RMA). Items must be unused, uninstalled, and returned in original containers and packaging. Approved returns are subject to a twenty percent (20%) restocking fee. Buyer is responsible for all return shipping costs unless the return is due to Seller error.

Payment Terms

Payment is due as stated on the invoice or order confirmation. Seller reserves the right to suspend services or cancel orders in the event of non-payment.

Taxes, Title & Registration

Buyer is responsible for all applicable sales tax, title transfer fees, registration fees, and related governmental charges.

Limitation of Liability

Seller’s liability shall not exceed the purchase price of the product sold. Seller shall not be liable for indirect, incidental, or consequential damages.

Governing Law

All transactions shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the appropriate courts located in Texas.
